Public Offer (Terms of Service)

Public offer for the provision of services by the «aviso.bz» service.
«Aviso.bz» offers you the services of the website on the terms that constitute the rules of use of the website «aviso.bz». The Site Administration treats these rules as a public offer.

1. Terms and definitions

1.1. «aviso.bz» is a website on the Internet (hereinafter the "Project" or the "Site") that, on the terms of this user agreement, gives Users the ability to place orders for work (services, tasks) and/or to accept such orders for execution on terms agreed between the Customer and the Contractor. Neither the owner of «aviso.bz» nor the Site Administration may under any circumstances act as a Customer or a Contractor; they act solely as intermediaries between these parties.
1.2. "Account" — an identification record assigned to each User that contains information about the User, payment details, statistics, balance and other data.
1.3. "User" — a person who has accepted this public offer by registering on the Site «aviso.bz».
1.4. "Advertiser" ("Customer") — a User who places an order using the Site «aviso.bz».
1.5. "Contractor" — a User who performs an order, or part of it, placed by an Advertiser on the Site.
1.6. "Referral" — a User invited to the Project by another User via a unique referral link.
1.7. "Referrer" — a User who has invited other Users to the Project via a unique referral link.
1.8. "Authentication and authorization" ("Login") — obtaining access to the Account by entering identification data (username/e-mail and password, WMID token, social network token, API key, etc.) on the Site «aviso.bz».
1.9. "Ban" — blocking of the User's Account that excludes the possibility of logging in and of any actions by the User through the Account.

2. General provisions

2.1. By registering on the Site, the User unconditionally accepts and follows all clauses of this offer.
2.2. The Administration has the right to unilaterally amend this public offer at any time by posting its new full version on the Site at https://aviso.bz/en/rules. The new version takes effect from the moment of publication.
2.3. Additional rules located in individual sections of the Site are an integral part of this offer.
2.4. The Administration recommends that Users regularly check this public offer for amendments and/or additions. Continued use of the Project after amendments and/or additions have been made means that the User accepts and agrees to them.
2.5. The Administration has the right to delete the Account of any User with no login activity for more than 1, 3, 6 or 12 months; Accounts blocked for violation of the rules are deleted with all balances reset to zero. All referrals pass to the referrer one level up; if there is no such referrer, the referrals become free.
2.5.1. Within 7 days after registration you must activate your Account by confirming your registration e-mail. Unconfirmed Accounts are deleted 7 days after registration.
2.6. The Administration is not obliged to train Users in the software required to interact with the Project.
2.7. If the User discovers violations, bugs, inaccuracies, errors, ways of cheating the system or bypassing protection in the operation of the Project, they must report this to the Administration. The User must not use them to obtain personal benefit or benefit for third parties, to disrupt the Project for any purpose, or to cause any harm to the Administration or other Users.
2.8. The Administrator (including moderators and assistants) has the right to delete any materials posted by Users without explanation.
2.9. In case of violation of any clause of this offer, the User may receive a warning, a fine, a restriction on the use of the Project, or a Ban of the Account in the form of a special public record called a "Black Ticket". The penalty is determined by the Administration; claims and complaints are not accepted.
2.9.1. The Administration alone decides whether to penalize a User and which measures to apply (the type of Black Ticket). A User who complains about another User may not dictate to the Administration which penalty to apply (or not apply).
2.9.2. The Administration does not disclose the ways and methods of identifying violators or the details of specific violations, since disclosing such information could help violators deceive the Administration more effectively.
2.10. If a violator's Account is blocked, losses are not compensated and all active advertising campaigns are stopped. The unused balance of the advertising account is refunded in the cases provided for by the Refund Policy.
2.11. All fees related to transferring funds to or from the Account, for any purpose and in any direction, are paid by the User.
2.12. The only way to delete an Account at the User's own request is a personal request by the User to technical support, stating the reason for deletion.
2.13. The Administration does not take part in any disputes between Users, including between an Advertiser and a Contractor. Any disputes between Users that do not concern violations of this offer are resolved by the parties without involving the Administration.
2.14. The User consents to receive technical, informational and advertising materials at the e-mail address provided at registration and at other contact details specified in the Account.
2.15. The Administration has the right to restrict the User's access to any service or section of the Project without explanation.
2.16. The official language of the Project is Russian; all materials and messages posted by Users directly on the Site must be in Russian unless the description of a section (instructions, additional rules, explanations) allows otherwise.
2.17. By registering on the Site, you agree that if you have a referrer, they may sell you on the referral marketplace to another member of the Site without your consent or prior notice.
2.18. The User is personally responsible for any information they post on the Site or communicate to other Users, and for any interactions with other Users, which are carried out at their own risk.
2.19. The User, as the owner of the information posted on their personal page, understands that, except in cases established by these Rules and applicable law, the Site Administration does not take part in forming and using the content of, or controlling other Users' access to, the User's personal page. By posting information on the personal page, including personal data, the User understands and agrees that this information may be available to other Internet users given the architecture and functionality of the Site.
2.20. The login and password chosen by the User are necessary and sufficient information for the User's access to the Site. The User may not transfer their login and password to third parties and bears full responsibility for their safekeeping, choosing the storage method independently.
2.21. The Site Administration may, but is not obliged to, review the Site for prohibited Content and may delete or move (without warning) any Content or Users at its sole discretion, for any reason or no reason, including without limitation Content that, in the Administration's opinion, violates these Rules or applicable law and/or may violate the rights of, cause harm to, or threaten the safety of other Users or third parties.

3. Obligations of Users

3.1. When registering and filling in the profile, provide genuine information in all form fields. Providing false data is a violation and may result in the Account being blocked.
3.2. Use the Site's internal mail system or the feedback page to communicate with the Administration. Users' requests are handled in order of receipt.
3.3. The Administration has the right not to respond to a request from any person if the request contains materials listed in clause 3.5 of this offer.
3.4. If questions arise about using the Site, the User should ask their Referrer for advice via internal mail, and should always be ready to advise their own Referrals on how the Site works.
3.5. It is prohibited to send spam, flood, insults (including veiled ones), obscene language (including veiled), pornography (including erotica) or other indecent messages (materials) in any way in any section of the Project. It is prohibited to use the Site's resources for extortion, threats, begging or other actions contrary to applicable law.
3.5.1. Each User is personally responsible for the messages (materials) they send and their content. The Administration may apply a penalty (issue a Black Ticket) and delete messages (materials) that show clear signs listed in clause 3.5; in all other cases the Administration has the right not to interfere in communication between Users. The Site Administration is not responsible for the content of messages and materials distributed by Users using the Site's resources.
3.5.2. If a complaint is received from a User, an administrator or moderator may view the User's messages (correspondence) related to that complaint. The User fully agrees to this.
3.6. It is strictly prohibited to register more than one Account! If two or more Accounts used by one User are discovered, all Accounts involved in the violation may receive a Black Ticket up to and including blocking of the Account. The violator's status, reputation and balance will not be taken into account.
3.7. It is prohibited to register several Accounts or to log in to more than one Account from a single computing device. All Accounts involved may receive a Black Ticket up to and including blocking. Status, reputation and balance will not be taken into account.
3.8. It is prohibited to use the same registration data (or identification data) in more than one Account, including payment system wallet numbers. All Accounts involved may receive a Black Ticket up to and including blocking. Status, reputation and balance will not be taken into account.
3.9. Re-registration is prohibited if the User's previous Account was blocked (Banned) for violating the Project rules. A new Account registered after blocking may receive a Black Ticket up to and including blocking. Status, reputation and balance will not be taken into account.
3.10. The use of automation software ("auto-clickers", "auto-browsers", "timer accelerators") is strictly prohibited. This also applies to any other software that operates the User's Account.
3.11. Distribution of the referral link must be organic and appropriate; spam in all its forms is unacceptable. Users who send out their referral links using spam methods may receive a Black Ticket up to and including blocking.
3.12. The User bears full responsibility for the safekeeping of passwords and other identification data (including WMID, social network accounts, API keys, etc.) used to log in. The Project provides all necessary and sufficient tools to protect the User's Account; any losses resulting from unauthorized access to the Account are not compensated.
3.13. Payment details and other User data may be changed only in the way provided by the Project interface in the corresponding section of the Account settings; there is no other way to change them.
3.14. It is prohibited to use the Project's services (functions, settings, features) other than for their direct purpose or contrary to the description given in the corresponding sections of the Site.
3.15. The Project is not a means of payment or an exchange office; there is no function for direct or arbitrary transfer of funds between Users' Accounts. Attempts to deceive the Administration in order to carry out such operations, and/or carrying out such operations, are a violation of this user agreement.
3.16. It is prohibited to publish or pass on to other Users (outside the task execution mechanism itself) reports and control answers to tasks and other advertising campaigns of Advertisers, and likewise to use such published or passed-on reports and answers to perform tasks and other actions provided for by an advertising campaign. This clause does not apply to Advertisers' actions regarding their own campaigns.
3.17. Sending false task completion reports may result in a Black Ticket up to and including blocking. The Administration may periodically analyze Users' task reports to identify violators who do not perform tasks but nevertheless send completion reports.
3.18. It is prohibited to create (distribute, use) methods (techniques, software, instructions) intended to deceive, hack or disrupt the Project's services, or to perform other actions that cause damage to the Project or its Users.
3.19. It is prohibited to distribute false and/or unverified information that causes financial and/or reputational damage to the Project.
3.20. The fact that a customer uses the Project's services is private information (for Project Users only) unless the service explicitly provides otherwise. Disclosure of this information (or threats of such disclosure) to third parties is a violation and may result in a Black Ticket up to and including blocking.

4. Obligations of Advertisers

4.1. Advertisers bear full responsibility for the content of the resources they advertise and for the materials used in their advertising campaigns. Any damage, including material damage, related to an incorrectly placed order, the content of advertising materials or the use of broken links is not compensated.
4.2. Advertising of the following Internet resources is prohibited:
— containing viruses or phishing sites/links;
— containing unwanted software installed without explicit warning or user consent;
— blocked by Yandex Safe Browsing or Google Safe Browsing;
— containing programs/materials/services for hacking software, websites, protected systems or accounts, and any resources related to hacking;
— outright scam sites;
— containing pornography (for any order type) or erotic materials (for direct display: visits, surfing, e-mails, banners, etc.);
— resources with services/goods/materials of an intimate nature, "one-night" dating sites and the like, and other "adult" resources in the intimate sense;
— inciting violence, racism, nationalism, immoral behaviour or criminal acts;
— political, religious or socially divisive;
— casinos, bookmakers, binary options, forex, investments (except banking and securities), financial pyramids;
— resources collecting donations, except official foundations and aid centres;
— sites that disrupt the normal functioning of the Project or its parts and software modules;
— sites "not for people", with a large amount of advertising, pop-ups, "heavy" content, etc.;
— sites that take unreasonably long to load, regardless of the reason;
— violating the laws of Georgia, the laws of the User's country or international law.
4.2.1. If any Internet resource/material (not included in the list in clause 4.2) used by an Advertiser in its campaigns could potentially cause negative consequences for the Project, the Administrator has the right to prohibit/block the use of such resources/materials (both for an individual Advertiser and for the whole Project), including by issuing a "Ban" type Black Ticket.
4.2.2. If an Advertiser reuses an Internet resource/material (not included in the list in clause 4.2) that has been prohibited by the Administrator, the Advertiser may receive a Black Ticket up to and including blocking.
4.3. If an Advertiser posts information about goods or services subject to rules and restrictions, the Advertiser must hold all necessary permits, licences or certificates and provide copies within three days at the Administration's request.
4.4. An Advertiser may not, in an advertising campaign, address Users on behalf of the Administration or of any other User (other than in their own name), or mislead Users about the process of viewing the advertised site (performing the task) or about receiving a reward for it.
4.5. It is prohibited to post tasks that require sending paid SMS messages (or other payments) whose cost exceeds the reward for the task (except for the "investments" and "transfer" sections), or tasks whose report requires providing access data to personal accounts or other personal payment data.
4.6. It is prohibited to place advertising campaigns with incorrect data and settings that make automatic payment impossible or otherwise disrupt the Project.
4.7. It is prohibited to create tasks with deliberately impossible conditions or conditions that cannot be met within the time allotted. It is prohibited to check and pay for a task outside the Project mechanism. Task conditions may not require any actions before the "Start" button is pressed; all actions must be performed after the request is created (the "Start" button is pressed).
4.8. It is prohibited to create identical (or almost identical) tasks, or several tasks that could be replaced by one reusable task.
4.9. It is prohibited to create "negative" tasks (campaigns): negative comments and materials, dislikes (negative ratings), insulting comments/materials, filing complaints about anything and other similar "negative" actions.
4.10. It is prohibited to request/use Users' details in a way they cannot control. For example, requesting a Contractor's phone number and then asking them to send the text of an SMS received on that number.
4.11. Tasks whose completion may result in the Contractor incurring debt obligations are prohibited.
4.12. Tasks whose conditions include transferring funds directly from the Contractor to the Customer (for example, via e-wallets, bank cards or transfers) are prohibited.
4.13. Advertising campaigns may at any time be stopped and sent for moderation to check compliance with the Project rules. Moderation may take up to 7 business days (or longer in non-standard cases).
4.14. In dynamic links/surfing and advertising e-mails, an advertisement that receives 10 complaints from Users is automatically removed and sent for moderation. If the complaints prove unfounded, the link resumes; if they are confirmed, the advertisement is deleted without a refund.

5. Financial relations

5.1. Each User has 2 internal accounts in the Project: the "advertising account" and the "main account". All Contractor rewards for tasks and other actions are credited to the main account, from which the User can withdraw funds to their payment system wallets. The advertising account is used to order services. Funds cannot be transferred from the advertising account to the main account or withdrawn to the User's wallets. The unused balance of the advertising account may be refunded in accordance with the Refund Policy.
5.2. The advertising account is topped up automatically by Visa and Mastercard bank cards and via the payment methods available on the top-up page in the User's account. As soon as the Project receives a payment notification from the payment provider, your advertising account is credited instantly and you can order services. The advertising account is topped up only via the top-up page in the User's account (a top-up request is created). Direct payments to the Project's wallets without such a request are not credited to the advertising account.
5.3. Payment and service obligations are considered fulfilled from the moment the funds are credited to the account of the Site «aviso.bz» and the corresponding technical, informational and other resources of the System are activated.
5.4. When funds are transferred to pay for the services of the Site «aviso.bz», the payment system fee is covered by the paying party. The account currency of the Project is the Russian ruble (RUB); when paying by bank card, the exact amount to be charged in the payment currency (GEL) is shown before the payment is confirmed.
5.5. Settlements between participants are made between the Customer and the Contractor through the Site «aviso.bz».
5.6. Withdrawal from the main account may be automatic (instant) or subject to a check (1–4 days), depending on your status in the Project. The withdrawal amount and frequency depend on your status. Withdrawal is available after confirmation of your mobile number. The first payout may be made after a check (1–4 days) depending on circumstances. In rare cases a payout may be made only with a check (1–4 days), regardless of your status.
5.7. Withdrawal from the main account is made according to the current tariffs published on the Site and includes all costs of the Site «aviso.bz» of executing the instruction.
5.8. The Project is not a representative of either the Advertisers who publish their orders on the Site ("tasks", "visits", "e-mails", etc.) or the Contractors who perform these orders in whole or in part, and therefore cannot be liable for any financial obligations arising between them. Any agreements between Advertisers and Contractors using the Site are bilateral and the Project is not a party to them.
5.9. The Site has the right to block the User's access to the System at any time for violation of this offer or other documents governing the Site. The unused balance of the advertising account is refunded upon blocking in the cases and in the manner provided for by the Refund Policy. Other expenses of the User are not compensated by the Site «aviso.bz».

6. Other terms

6.1. The Project Administration does not guarantee constant or unconditional access to the services. The Project's operation may be disrupted by force majeure and other factors beyond the Administration's control.
6.2. The Project is provided "as is"; the Administration is not responsible if the results obtained from using the Project do not meet the Users' goals and expectations.
6.3. The Administration is not liable for any direct or indirect losses arising from the use of or inability to use the Project, or from unauthorized access to the User's communications.
6.4. The Administration is not liable under any contracts or agreements between Users, does not guarantee any contracts, transactions or relations between Users, and does not regulate or take part in Users' personal disputes.
6.5. The Site Administration is not liable to third parties for the content of information used in materials posted by Advertisers, or for property, moral or any other damage caused by third parties' use of such information.
6.6. If any terms of the service are not covered by this offer or described on the Site's pages, contact the Administration for clarification and follow the instructions given.

7. Governing law and disputes

7.1. The relationship between the User and the service provider is governed by the laws of Georgia. The User must also comply with the laws of their country of residence when using the Project.
7.2. All disputes are resolved by negotiation through the Project's technical support. If no agreement is reached, the dispute is referred to the court at the service provider's location in accordance with the laws of Georgia.
7.3. The refund procedure is set out in the Refund Policy and the processing of personal data in the Privacy Policy. Both documents are an integral part of this offer.
